“ULTGAR - Win a Madd Gear Team Scooter” Promotion Terms & Conditions

 

  1. The “ULTGAR” Win a Madd Gear Team Scooter (the “Promotion”) is sponsored by Ultimate Garage (“Promotor”).
  2. The Promotion is governed by these official Terms & Conditions (“Terms & Conditions”).
  3. By participating in the Promotion, each participant agrees to be bound by these Official Terms & Conditions.
  4. The Promotion is open from [12:00am] [04/17/2019] and ends on [11:59pm] [04/26/2019] (the “Entry Period”).
  5. Entries not complying with these Official Terms & Conditions are ineligible and the Promoter may in its sole discretion disqualify any participant.
  6. The Promotion is restricted to the United States and anyone can enter. If You are under 18 years of age, You must have the consent of your legal guardian to enter the Promotion.
  7. Directors, managers and employees of the Promoter or any retailers, agencies or companies associated with the conduct of the Promotion, and any family members thereof, are not eligible to participate in the Promotion.
  8. In order to enter the Promotion a sticker purchase is required.
  9. All entries remain the property of the Promoter.
  10. The Promoter will select a random winner from the successful entries and they (the winner) will receive “the prize” of a MGP Team Scooter. The Promoter's decision is final, and no correspondence will be entered into.
  11. All times and dates are EST unless stated otherwise.
  12. No component of the “Win a MGP Team Scooter” “prize” is transferable.
  13. The successful entrant will be notified by email or phone within 2 days of selection. The successful “Win a MGP Team Scooter” winner will also be published in the ULTGAR email newsletter.
  14. The Promoter reserves the right to verify the validity of the entries of any person and/or including requesting proof of purchase. Failure to adhere to the official terms and conditions or, refusing this request will immediately invalidate a winner's right to the “Win a MGP Team Scooter” “prize”.
  15. By entering into the Promotion, You expressly consent to Your entry and personal information (including Your name and contact information) being used by the Promoter, its employees and agents: (a) to administer the Competition; (b) to announce the winner; (c) for any promotional, marketing, publicity, research and profiling purposes of the Promoter (without any requirement for your further consent or any payment or other compensation to You); and (d) to disclose to third parties as required by law (including, without limitation, any Agency).
  16. Any and all personal information of the participants that is collected by the Promoter in connection with the Promotion will be handled in accordance with the Promoter's Privacy Policy at www.ultgar.com and these Official Terms & Conditions.
  17. The winners agree to participate in any reasonable media activities surrounding the Promotion.
  18. The winner consents to the Promotor’s: (a) making images or recordings, whether sound, digital or otherwise of the winner any activity referred to in paragraph 19; (b) using, publishing or reproducing, in perpetuity, the images and recordings in any form, in whole or in part, and in any medium including but not limited to websites, social media, television advertisements, promotional videos, brochures, newspapers, articles, multi-media, for public relations, promotions, commercial and advertising purposes, whether for consideration or otherwise (Promotional Material); and (c) using and disclosing the winner’s name and age together with any image or recording of the winner (including those incorporated into Promotional Material).
  19. The winners agree and acknowledge that it does not have any interest in the copyright to the Promotional Material nor shall he or she be entitled to receive any ongoing payment (outside of the initial “prize” outlined in paragraph 10), royalty or other consideration (whether monetary or otherwise) from the Promoter.
  20. If any winner is under 18 years old, the winner must, at the Promoters request, provide to the Promoter the full name, address and telephone numbers of each legal guardian for the winner. It is a condition to any winner under 18 years old participating his or her legal guardian consent and if required provide a signed consent or release to paragraph 15, 16, 17, 18 or 19 above.
  21. Except for any liability that cannot be excluded by law, the Promoter, its officers, employees and agents shall not be liable (whether in contract, tort or otherwise) for any personal injury or death of any person or any loss or damage of any kind (including, without limitation, any loss of opportunity), whether direct, indirect, special or consequential, arising from or in connection with the Promotion or any prize, including, without limitation, where arising from or in connection with: (a) any technical difficulties (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value from that stated in these Official Rules; and/or (e) any tax liability incurred by a winner or any entrant.
  22. The Promoter reserves the right to cancel, modify or suspend the Promotion, subject to any requirements and directions from any relevant Agency.
  23. In the event of any dispute in relation to the Promotion, the decision of the Promoter is final.
